BIM Grants Privacy Notice

Bord Iascaigh Mhara (BIM), Crofton Road, Dún Laoghaire, County Dublin, as the Data Controller, has created this notice to outline the manner in which personal data will be handled and processed in compliance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA) for the purpose of administering grants.

This Privacy Notice provides you with information about the processing of personal data by BIM. For BIM to effectively deliver and administer grants, it is necessary to process personal data. Personal data means any information capable of identifying you as an individual, such as your address or telephone number.

Purpose of Processing

BIM has primary responsibility for the day-to-day processing of your personal data collected under the various grants schemes that it operates. As such, BIM is responsible for the following activities:

Please note that prior to the payment of grants, data relating to your financial standing with both BIM and DAFM, at any time during the application process may be shared between them. Should an applicant have monies overdue to either BIM or DAFM this amount may be offset against the payments to be made under this scheme.

The lawful basis for this process is Public Task (Article 6(1)(e) GDPR). BIM allocates funding made available by the European Union and Irish Government. Expenditure under schemes managed by BIM under various EU funds that are established under various regulations, for example, funding under the Seafood Training Scheme (Fisheries) is made available under the Training and Capacity Building Scheme, which is established under Union Priority 1 (Sustainable Development of Fisheries) and Union Priority 2 (Sustainable Development of Aquaculture) of Ireland’s Operational Programme under the European Maritime, Fisheries and Aquaculture Fund 2021-2027, co-funded by the Government of Ireland and the European Commission. The applicable legislation for each grant is defined below.

Disclosure of your information

Your personal data that BIM holds may be shared with government departments, national or EU agencies with responsibility for the marine and online application administration. Details of projects may be shared with the Managing Authority for the European Maritime, Fisheries and Aquaculture Fund (EMFAF), and details of any supports will be published online as required by Regulation (EU) 2021/113 of 7 July 2021 establishing the European Maritime, Fisheries and Aquaculture Fund and amending Regulation (EU) 2017/1004.

BIM may also share details of your application with FLAG boards. These are groups established to assist their local communities in providing guidance on how to complete grant applications and reviewing applications. FLAG board members can only see the applications for which they are a reviewer.

BIM will only permit contracted service providers to process your personal data for specified purposes and in accordance with its instructions. Only the minimum personal data necessary will be shared with these providers.

International Transfers

BIM does not currently transfer data outside of the EEA for the purposes of grants administration.

Your rights as an individual

Under the GDPR and the DPA, you have a number of rights with regard to your personal data:

If you believe that BIM has not complied with the requirements of the GDPR or DPA, you have the right to lodge a complaint with the Data Protection Commission, available at info@dataprotection.ie or by post 21 Fitzwilliams Square, Dublin 2, D02 RD28.

If you wish to exercise any of your rights, please contact us at dataprotection@bim.ie. We will seek to deal with your request without undue delay, and in any event within one month (subject to any extensions to which we are lawfully entitled). Any request to access personal data will be dealt with free of charge unless it is considered excessive in which case, we may charge a reasonable fee.

Automated decision making

We do not engage in fully automated decision making which has significant or legal effects on you in the provision of our services.

Data Retention

All personal data will be retained for as long as is necessary and in line with BIM’s Retention Policy. For more information about how long your data will be retained, please contact dataprotection@bim.ie.

Data security and storage of personal data

We use a range of physical, electronic, and managerial measures to ensure that we keep your personal data secure, accurate and up to date. These measures include education and training to relevant staff to ensure they are aware of our data protection obligations when processing personal data, administrative and technical controls to restrict access to personal data to a need-to-know basis, technological security measures, including firewalls, encryption, and anti-virus software; and physical security measures, such as staff security passes to access our premises.

All information you provide to BIM is stored on secure servers. Where BIM has provided you with (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
